Personal Injury Trusts

If you have been awarded compensation (damages) due to a Personal Injury claim you may find that you are no longer entitled to certain means tested benefits, either now or in the future.

A Personal Injury Trust is a legal document that allows any compensation you receive to be disregarded when considering means tested benefits entitlement.  It can also protect any compensation from being used for future residential care fees.

It is best to consider the future implications of your compensation award at the outset and set up a Personal Injury Trust so to retain the compensation and retain your rights to means tested benefits and state help, whether now or in the future.

General Trusts

Trusts can be a great option, when you are considering your Estate and assets.  There are many reasons for doing this and they can be done during lifetime or via your Will, which is when the majority of trusts are set up.  The main Trusts include the following;

• Disabled Person’s Trust – These allow you to leave an inheritance to a disabled person, for their benefit, without affecting their means tested benefits.
• Children’s Trust fund – These are when you decide to leave your children an inheritance, before they have attained majority age or other age that you state, so to safeguard the inheritance for them.
• Property Trust – these are used to protect your home from second marriages and/or care fees etc and to ensure that you provide a roof over a loved one’s head.
• Discretionary Trust – these are used when you want to save your assets from being depleted unnecessarily, allowing your Trustees greater flexibility to decide when and how assets are distributed or used.
