What is ‘Unreasonable Behaviour’ in Divorce Proceedings?

The Term ‘unreasonable behaviour’ is used to describe the fact that your partner has behaved in such a way that it would be unreasonable to expect that the relationship can carry on. Unreasonable behaviour is the most common grounds for Divorce in the UK right now.

Can I file for Divorce based on Unreasonable Behaviour?

To file for Divorce on the grounds of unreasonable behaviour you must be able to show that your partner has behaved in an unreasonable manner, that you find it intolerable to carry on in the relationship and that this behaviour has caused the irretrievable breakdown of your marriage.

What are examples of Unreasonable Behaviour?

There is no definitive list, but we have listed the most common reasons here:

  • Domestic Abuse whether it be physical or emotional
  • Excessive spending, running up debt or gambling, which has caused financial strain
  • Your partner having an inappropriate relationship with someone else
  • Lack of sexual relations within the marriage
  • Alcohol/drug abuse
  • Lack of support, whether this be emotional or general support i.e. domestic duties, with your career or other aspects
  • Not wanting to socialise
  • Disputes within the family and/or refusal to engage in family life.

Although the Government will be introducing ‘No Fault Divorce’ meaning that couples can divorce without the need for showing unreasonable behaviour, this will not come into effect until late 2021.
